CONSCIOUS ELEGANCE TERMS & CONDITIONS
In these conditions, unless the context requires otherwise:
1.1 ‘Buyer’ means the person who buys or agrees to buy the goods from the Seller;
1.2 ‘Conditions’ means the terms and conditions of sale set out in this document;
1.3 ‘Delivery Date’ means the date in the box marked ‘Delivery Date’ in the Order Form;
1.4 ‘Goods’ means the articles which the Buyer agrees to buy from the Seller;
1.5 ‘Invoice Payment Date’ means the date when cleared funds have been received in respect of the invoice;
1.6 ‘The Order Form’ means the form containing the buyer’s dress details and signature .
1.7 ‘Price’ means the price for the Goods as quoted on the website and specified in the box marked ‘Total Price’ on the Order Form and will include all appropriate delivery charges to the Buyer.
1.8 ‘Seller’ means the person whose name and address appears in the box marked ‘Seller’ on the Order Form.
2 Conditions applicable
2.1 All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Conditions.
2.2 The Buyer shall be responsible for ensuring the accuracy of the details provided on the Order Form.
3 Price and Deposit
3.1 On placing the order the Buyer must pay 25% of the Price. This deposit is non-refundable save for the cancellation of the Contract in accordance with clause 9 or clause 10.
3.2 When the Goods are ready for delivery the Seller shall issue an invoice to the Buyer detailing the amount outstanding for the Goods.
3.3 The Buyer must ensure that the Seller has received cleared funds for the amount specified on the invoice for the Goods at least 7 working days prior to the Delivery Date.
3.4 Payment may be made in $US by Paypal, eCheck, personal check or cash.
3.5 Payment may be in non-US currency via Paypal or bank transfer.
3.6 For overseas orders the time periods specified in clause 3.3 are likely to be increased.
4 Delivery of the Goods
4.1 The Seller shall not be bound to deliver the Goods until the Buyer has paid the Price in full.
4.2 The Goods will be dispatched within 3 working days from when the Seller has received cleared funds of the Price.
4.3 Subject to clauses 4.1 and 4.2 above the Seller will endeavor to deliver the Goods by the Delivery Date and the Seller will issue the Buyer with an email when the Goods have been dispatched.
4.4 The Goods will be delivered to the address provided by the Buyer on the Order Form.
4.5 A signature will be required to acknowledge delivery. The signature of the person accepting the delivery at the delivery address will be proof that the Buyer has received the delivery.
4.6 The Buyer shall make all arrangements to take delivery of the Goods whenever they are tendered for delivery.
5 The Goods
5.1 The quantity and description of the Goods shall be as set out in the Order Form.
5.2 Further alterations to the Goods when the Buyer is in receipt of them shall be at the cost and risk of the Buyer.
6.1 A refund will only be given where the Goods are faulty or do not meet the specification set out in the Order Form.
6.2 If the Buyer is dissatisfied with the Goods for any of the reasons specified in clause 6.1 they must report to the Seller by email within 3 days of receipt of the Goods. After that period the Buyer shall be deemed to have accepted the Goods.
6.3 The Goods must be returned to the Seller in the same state in which they were supplied within 14 days of notifying the Seller of the intention to return the Goods.
6.4 The Seller accepts no responsibility for fair wear and tear, misuse or accidental damage occurring once the Buyer is in receipt of the Goods.
6.5 The Buyer will be responsible for all costs involved in returning the Goods, unless the goods were damaged in transit to the Buyer.
7.1 If any damage is caused to the Goods whilst in the Buyer’s possession the Buyer may report this to the Seller by email.
7.2 The Seller may at their own discretion agree to repair the Goods at a price agreed between the Buyer and the Seller.
7.3 The Buyer will be responsible for all costs in returning the Goods to the Seller and the redelivery of the Goods.
8 Title and risk
8.1 Title shall pass when the Buyer pays the full Price.
8.2 Risk shall pass when the Buyer is in receipt of the Goods.
9 Force Majeure
9.1 Neither party shall be liable for any default due to any act of God, war, civil disturbance, malicious damage, strike, lockout, industrial action, fire, flood, drought, extreme weather conditions, compliance with any law or governmental order, rule, regulation or direction (‘Force Majeure Event’).
9.2 Each party shall give notice forthwith to the other upon becoming aware of a Force Majeure Event, the notice to specify details of the circumstances giving rise to the Force Majeure Event.
10 Seller’s right to cancel
10.1 The Seller reserves the right to cancel the order for Goods due to unforeseen or unavoidable circumstances.
10.2 In the event of such circumstances the Seller will notify the Buyer by email and refund in full any money paid as soon as possible.
10.3 The Seller will NOT have the option to cancel the order in accordance with clause 10.1 above if there is less than 3 weeks until the Delivery Date.
11.1 If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms and conditions and the remainder of the provision in question will not be affected.
11.2 The headings in these Terms and Conditions are for convenience only and will not affect their interpretation.
Our Ethical Pledge
The silk we use in our designs is either new hempsilk or reclaimed silk fabrics, repurposed from unwanted dresses which would have eventually ended up in a landfill. We believe that by giving pre-loved dresses a new life and extending their usefulness, we not only honor the initial sacrifice of the silkworms but we honor the laborers who wove the original fabric. We do this by reclaiming and re-using a resource that would otherwise be wasted.
